Dear Client,
In the case where you have been informed by your neighbour that your dog has wet her potted plants in the society compound then there are things you need to know. Since it is a common area she cannot own the space exclusively, and her claims can amount to harassment if your pet did not relieve itself on her plants. To address this, write the events down, including dates, times, or anyone who may have seen or heard the incident. The first thing to do is to try to talk with your neighbour and explain the problem to them if you can. If such harassment persists, the victim could seek the assistance of the local police through a complaint under Section 349 of Bharatiya Nyaya Sanhita (previously, Section 504 of IPC) for intentional insult. In addition, it is advisable to involve the managing committee of the housing society to intervene and mediate. If the problem goes unaddressed, you can sue for harassment or nuisance under the Law of Torts. Some of the laws includes Section 268 & Section 290 of Bharatiya Nyaya Sanhita (previously, Sections 268 and 290 of IPC) which are related to the public nuisance. It is therefore important to involve a legal practitioner in the handling of this matter so that your rights may be well protected.
Hope this answer solves your problem.
