Vehicle blacklisted after noc is issued to second hand car buyer

Vide circular bearing number RT-11036/09/2023 dated 2nd January 2023 issued by the Ministry of Road Transport and Highways, Govt. of India has provisioned for flagging/blacklisting of vehicles on vahan portal for the registered vehicle owners who defaulted on loan repayment of their vehicles under Section 51(5) of the Motor Vehicles Act, 1988 and reported by the financier in Form - 36 of the Central Motor Vehicle Rules, 1989 to the RA outlining the categories of flagging of vehicle as "Not to be Transacted". Accordingly, the Bank has informed the defaulter vehicle owners invoking its right under said circular. As per said circular, in case of challan not deposited within 90 days as per Rule 167 of CMVR, 1989 vehicle will be flagged as "Not to be transacted" and the system shall send a text message to the registered owners and the concerned registering authority/RTO. So, in the given situation, you should visit the office of the concerned RTO as well as the office of the concerned financer/Bank for more clarification and steps to be taken to navigate the issue in the right way.

If your vehicle is blacklisted by the RTO that issued your No Objection Certificate (NOC), you can contact the office that issued the registration certificate to remove the vehicle from the blacklist. Send a complaint letter addressing the RTO where the NOC was issued. Include all relevant details, such as the vehicle's registration number, the NOC issued, the delay in the transfer process, and the blacklisting issue you discovered. Request the RTO to clarify the reason for the blacklisting and to take corrective action. If the RTO does not resolve the issue, escalate your complaint to the Regional Transport Commissioner or the Transport Department of your state. If it does not work, send a legal notice to both the broker and the RTO. State that the broker refunds the full amount you paid for the vehicle or resolves the issue and the RTO removes the blacklisting and allows the transfer of ownership. Give a specific deadline. If the broker or RTO fails to respond to the legal notice, you can file a case in the Consumer Court against the broker for selling you a defective product and the RTO for failing to fulfill their duty. You can seek a refund of the amount paid for the vehicle and also compensation for the harassment. We hope that our response is helpful to you.
