If the Mumbai Cyber Crime unit has placed a lien on the amount you received through a court order and is unresponsive despite you submitting the necessary documents, there are a few remedies you can pursue:
1. File a Complaint with the Higher Authorities
Contact Senior Officers: If the investigating officer is unresponsive, you can escalate the matter by approaching a senior officer, such as the Cyber Crime Branch head or the Commissioner of Police. Provide them with copies of the court order, FIR, and proof of attempts to contact the original officer.
Written Complaint: File a formal written complaint detailing the situation, including how the officer is not responding despite your compliance.
2. Approach the Court
Contempt of Court: Since the amount was granted through a court order, you can approach the same court and file a petition for contempt of court. The court may issue directions to the cybercrime unit to release the amount.
Application for Lifting the Lien: You can also file an application in court to remove the lien on the funds by proving that you have already been victimized in a cyber fraud case and that you have complied with the court's directions.
3. File a Complaint with Cyber Crime Cell
If the lien is unjustified, file a fresh complaint with the Cyber Crime Cell of Mumbai regarding the misuse of authority or delay in responding to your communications. This will compel the department to take action.
4. Send a Legal Notice
You can have your lawyer send a legal notice to the officer and the department, demanding immediate action or clarification on the lien and non-response. This formal notice may prompt quicker action.
5. RTI Application
File an RTI (Right to Information) application requesting details about the reason for the lien and the current status of your case. This will force the department to provide an official response within 30 days.
6. Ombudsman/Grievance Redressal
You can lodge a grievance with the State Police Complaint Authority or ombudsman for administrative redressal if you feel that the police are being negligent in handling your case.
Taking these steps should help in addressing the issue, ensuring that your funds are released, and that the authorities are held accountable for their actions.
