1)Right to Protection from Abuse:
Under the Juvenile Justice (Care and Protection of Children) Act, 2015, if you're being abused by family members, you can be removed from that environment and placed in safe care, such as a boarding school or child care institution.
If the abuse involves sexual offenses, the Protection of Children from Sexual Offences (POCSO) Act, 2012 allows you to file a complaint, and legal action will be taken against the abusers.
Right to Legal Representation and Fair Treatment:
2)Even if you have criminal charges against you, you're entitled to legal representation under the Juvenile Justice Act. You’ll be tried in juvenile court, which focuses more on your rehabilitation than punishment.
You can also request the court to place you in a safer environment, like a boarding school, if you can show that your home environment is abusive.
3)Right to Education:
The Right to Education (RTE) Act, 2009 guarantees your right to free and compulsory education. If you're in distress, this can include being placed in a boarding school for your safety.
4)Right to Be Heard:
You have the right to express your wish to stay in a boarding school if you feel it’s a safer place for you. This can be communicated to the Child Welfare Committee (CWC) or the court.
5)Approaching Child Welfare Authorities:
You or someone on your behalf can approach the Child Welfare Committee (CWC) or the National Commission for Protection of Child Rights (NCPCR). They can intervene to remove you from an abusive environment.
6)Rehabilitation and Counseling:
The Juvenile Justice Board can order rehabilitation and counseling, and can even place you in a boarding school if they believe it’s in your best interest, regardless of any criminal charges.
Remember the law is beside you and the focus of the law is to protect and rehabilitate you, ensuring your right to safety and well-being. You can communicate your wishes through a lawyer, social worker, or child protection authorities.
