I'm Vamshi Krishna from Hyderabad and recently say 15days back I bought a resale 2bhk directly from a owner in Hyderabad. I paid full amount and got it registered in my name but soon I realized that I paid more for that old property because the same sft apartment I was getting in the next block for much cheaper price. And also I'm facing lot of water leakage issues in this flat. I spoke to last owner and asked him if he could take back the flat and return my payment but since its already registered in my name the owner says he doesnt require that property anymore as such he sold it off and is saying he will no longer look into the pipe leakages in apartment as now I'm the present owner and it's not his duty. Can you please tell me is there a way I could file a case and get back my money and transfer back this property on the last owners name. Please advice.

A.After the completion of the sale it becomes the responsibility of the buyer and the seller has no responsibility.
The rule of "Caveat Emptor" [Buyers be aware] shall be applied. That the onus of checking the sale property should be done by the buyer before hand.

A.Dear Sir,
You may file a suit against him for damages for not disposing material fact of leakage etc. You may even seek for cancellation of such sale deed and seek relief of return back of sale amount paid by you.

Good Afternoon Sir.
Thank you so much for your positive reply. So if I file case will the last owner register back property in his name and return back the full payment. Because at time of registration on the documents it is stated I registered that 25yr old property for 11 lakhs but remaining amount I paid him separately not shown kn any documents it was a bank transfer. So will I get back even that amount which is not shown on registered documents?????. And when I spoke to owner he says as long as he was there no leakage everything is fine and now I'm just complaining as I want my money back . Last owner says after knowing it's a 25year old property and having documents throughly checked only you purchased so now I'm not interested in getting it back registered in my name as he no longer needs property. As such I want to file case on him as per your advice but will I get the full amount not just the one shown on registered document but the extra amount which I paid. Please advice.

A.Once deals completed then it's Ur mistake not seller. Nothing any other options

Thank you Mr Rameshwar Dadhe for you reply. But is there a way I could file a case by saying having many repair works water leakage in this flat which i bought as its 25yr old flat as such i want last owner to take it back and return my full payment. Can I file something in those lines.
