For compensation of damage

In one appeal, the Appellant withdrew the appeal after 7 years. He said that the appeal is not maintainable, hence he withdrew the appeal. What remedy is available to the respondent against the Appellant?

Dear Client,
Unless the appellant is permitted by the Court to withdraw the present appeal with the liberty to file appropriate proceedings before the appropriate forum, the appellant can not withdraw an appeal on his own on the grounds of maintainability. The Telangana High Court has reaffirmed the principle that an appellant has an absolute right to withdraw an appeal, and the court must grant such a request without imposing conditions, provided certain circumstances are met.
