Dear Client,
In your case, since you have filed a petition under Section 25 of the Guardians and Wards Act, 1890, which deals with the custody of a child, the court will decide custody based on what is in the best interests of your daughter. Several factors will influence the court’s decision:
The primary consideration for the court is always the welfare and best interests of the child. Factors such as the emotional, educational, and physical well-being of the child will be taken into account.
As your daughter is only 5 years old, courts typically prefer that young children, especially girls, remain with their mother unless there are exceptional circumstances that suggest otherwise. It is often believed that young children need the care and affection of their mother more than anyone else.
The court may look at your husband's living conditions, including the influence of other family members like the stepmother, stepbrother, and stepsister, to determine whether they are conducive to the child's well-being.
If you have been the primary caregiver before the separation, the court may favor maintaining continuity in the child’s care.
The court may also consider the relationship between you and your husband. If there is a history of discord, they will look at how it affects the child and whether a harmonious living environment can be provided.
Demonstrating that you have a stable source of income through your private tuitions and that you live in a house owned by your father will support your argument that you can provide for your daughter’s financial and emotional needs.
If your daughter has been emotionally closer to you and spent more time with you, emphasizing this can show that being with you is in her best interest.
Gather any evidence that shows your involvement in your daughter’s care, education, and upbringing. This can include school records, medical reports, and any other documents that show your active role as a mother.
In India mothers are mostly given physical custody of their daughter, if the father really wants and be able to give valid arguments then he may be granted with financial custody.
