Property joint way issue
Recently we have purchased a property that has joint way of 9 feet in document. There are four plots from west to east, we have bought property 3. 1,2 and 3 properties are belonged to same family(husband and wife) earlier. 1 and 2 are registered on husband name and 3 is on wife name. while selling plot 3 both wife and husband obeyed for 9 feet joint way and husband signed as witness in the sale deed agreeing for 9 feet passage. He also constructed his house according to that(leaving 9 feet joint way). Registration happened on 2010. From then it changed three hands and we bought it recently. After 13 years now the owner of 1 and 2 (who is the husbnd of the property we bought) denying 9 feet passage saying, in my document joint is only 7 feet. Now the wife who sold the property is also on same word that they will grant only 7 feet. We are now constructing house in that plot. My municipal building plan is also approved for 9 feet joint way. Is there a chance that i can get 9 feet way as the husband who is owner of property 1 and 2 signed as witness in sale deed. Are both wife and husband responsible to provide 9 feet joint way. We are facing lot of troubles because of this 7 feet way. According to indian civil law, is there a chance for me to get 9 feet joint way. The said wife and husband are causing us problem intentionally to demand some money from me. Here i need my 9 feet joint way as per my sale deed.
