The Permanent Alternate Accommodation Agreement(PAAA), must be executed between a developer, an existing member of a housing society, and the society itself when redevelopment occurs. This agreement establishes title over a new flat provided to the existing member. As per the Transfer of Property Act, 1882, any transaction pertaining to the immovable property exceeding Rs.100/- needs to be documented in writing and has to be registered as required under Registration Act, 1908. The developer requires NOC from the legal heirs of the property to protect the interest of the owner to avoid any claims from any legal heir successors before delivery of the flat post-redevelopment of the property. The siblings staying in Rajasthan can execute and register a Power of Attorney to other siblings authorizing them to do all the formalities required for registration to process the redevelopment of the building.
