Dear Concern,

Please let me know one thing.

Can company hold Travel Allowance(T.A) of any employee due to data intregity issue?

I had been working in one company for last 8 years and due to data intregity issue, i got terminated on Dec-2018. I was working as a field auditor inwhich i used to travel all over india for audit.

Company crosschecked my some audits of the month of Nov 2018 and they found these audits as a fake audits and i was not having any data with me so i could not prove it and got terminated.

Now company is not releasing my TA (Travel Allowance) which is around Rs-75000. However my FNF has been released.

Kindly confirm, what should i do? As company has denied to release my TA.

A.Kindly follow the following steps.

1. Send this company a legal notice to repay your TA within a specified time frame. [usually 15 days to 30 days].
2. If they do not comply with your legal notice, then, you can go ahead and file a suit for recovery of money against the company.

Thanks for your quick response.

I want to know that as i had already mentioned that i was terminated as company could not find my some audits on field of the month of Nov 2018 so my TA was not released.

I had already told them that they could deduct the required amount and release my remaining payment but it was not done.

Will it help me if i send legal notice?

Sir,
The lawyer who shall be preparing your legal notice shall see into the technicalities of the same and propose your desired action.
If Say for Example [T.A. held is Rs. 7lac] and deductible amount by way of fraud is [Rs. 5Lac] then your Legal notice shall have 2 criteria.

1. Let them know about the deduction in writing
2. Ask them to provide with a sheet of such deduction and then repay the remainder within the stipulated time frame.

A.Dear Sir,
Since you have already left the company as such you can send a legal notice and file a civil suit for recovery of the amounts.
