Until and unless a No Dues Certificate is issued by the lending Bank and the NDC of the bank is submitted before the Land Revenue Authority, the records of a mortgaged land will show a debt on the land. In the given scenario, in the absence of the clearance(NDC), you have to obtain a Court's order to effect the mutation in 7/12 records of the land. Accordingly, you have to file a suit for a declaration under Section 34 of the Specific Relief Act, 1963 before the competent Civil Court seeking an appropriate order to navigate the issue in the right way. Upon receipt of the Court's order, you need to visit the office of the Revenue Department and fill out a form with the details of the land and the owner and submit the same along with the required documents and fees. Once your application is verified, you will be issued the updated 7/12 extract from the revenue department office. If required, hire the service of an Advocate to navigate the issue in the right way.
