A.Dear Client,
A failure to comply with the contractual obligation on the part of a service provider is considered a deficiency in service and such deficiency makes a service provider liable to face consequences including payment of compensation. Post cancellation of online course and refund of coaching fees, it was the contractual obligation of the service provider, Byjus to inform the course financier to recall/revoke the ECS mandate on the ground of cancellation of a course by the consumer student. A consumer cannot be a victim of deficient service of the service provider and his partner financier. So, in the given scenario, serving a legal notice both Byjus and its financial partner, Aditya Birla Capital, a complaint against them over deficiency in service and unfair trade practices needs to be filed online mode through e-daakhil portal ( https://edaakhil.nic.in/edaakhil/ ) introduced by the Consumer Affairs Department, Govt. of India following the provision of the Consumer Protection (E-Commerce) Rules, 2020 and the Consumer Protection(Direct Selling) Rules, 2021 seeking appropriate relief and compensation for harassment. It may work faster to redress the grievance, failing which you may file an offline Complaint against the online service provider and its finance partner before the Dist. Consumer Court under whose jurisdiction a branch of the Byjus or a branch of Aditya Birla Capital is in operation for deficiency in service and unfair trade practice claiming an appropriate relief/direction to the service provider along with compensation for harassment. The complaint before the Consumer Court should be filed within two years from the date of the cause of action. Complaint should be filed within two years from the date of cause of action.
