Hello,
I have a property in the name of my father and his brothers in Varanasi, Uttar Pradesh.
Lets call them Person 1 , person 2 , person 3 and person 4.
Person 1 is my father.
Person 2 is my real uncle (deceased) but his wife is alive .
Person 3 is my real uncle and he is alive.
Person 4 is my real uncles son and his name is there on registry as he expired before the property was registered.

I am the son of Person 1 . Now if i want to register the property in my name , can i be exempted from stamp duty as uncle can gift the property (not sure) in uttar pradesh.

Also tell how much of it will be exempted and how much will i have to pay

A.Please file a partition suit and the court fee depends upon the market value of the partitioned property.
