The purpose of this complaint is to bring to your attention the mental harassment, emotional abuse, and continued financial instability that I have been subjected to for an extended period.
Since the beginning of my marriage, I have been enduring:
1. Mental Harassment: I have been constantly subjected to taunts, insults, and derogatory remarks from my husband and in-laws, particularly about my upbringing, my parents and family. Their comments have had a severe impact on my mental health and well-being. I endured this for 5 years living in a joint family, upon separating with in laws and living in a neutral family for over 2 years this has not stopped. My in laws have been influencing my husband to belittle me and cause tension and discomfort between husband and wife.
2. Character Assassination: My husband and in-laws have engaged in baseless accusations and character assassination, which have tarnished my reputation and caused me significant emotional distress.
3. Lack of Emotional, Physical, and Financial Support: My husband has been unemployed for 2.5 years and has refused to provide any emotional or financial stability to me and our family even when he was employed in last 7 years of marriage. My in-laws have been complicit in this behaviour, not only failing to provide support but also adding to the distress through constant emotional abuse. I have been working and providing for the household and meeting every need of my husband and the house.
4. Domestic Disharmony: The constant emotional abuse, lack of support, and overall negative environment have taken a toll on my physical health and have disrupted the peaceful atmosphere of our home.
Despite repeated efforts to resolve these issues within the family, their behavior has not changed, and the mental and emotional trauma continues to intensify. I fear for my well-being and my 4 year old son’s well-being and cannot endure the abuse any longer. (Gurgaon, Haryana)
A person can restart his or her life afresh at any stage or age if she or he is inspired or encouraged to do so by well-wishers. If you feel you can manage yourself outside without the support of others for all your needs, nothing prevents or restricts you from walking out of your matrimonial home to look for the destiny of your choice. So, you need to arrange for an independent source of income to live your life on your terms. However, in the prevailing toxic situation, you have the following legal remedies to resolve the crisis. 1) you can file a complaint against your husband and his other family members who subjected you to domestic violence in the local police station under Sec.12 of the PWDV Act, 2005. Under Section 12(1) of The Protection of Women from Domestic Violence Act, 2005, an aggrieved person or a Protection Officer or any other person on behalf of the aggrieved person may present an application to the Magistrate seeking one or more reliefs under this Act that include right to reside in a shared household, protection order and residence order provided that before passing any order on such application, the Magistrate shall take into consideration any domestic incident report received by him from the Protection Officer or the service provider. 2) you may consider judicial separation or divorce on the grounds of mental cruelty to resolve the matter permanently. Either spouse can obtain a decree of divorce if one spouse has treated the other with cruelty. Section 13 (1) (ia) of the Hindu Marriage Act, 1955, allows either spouse to seek divorce on the grounds of cruelty. If there is no possibility and no scope of mutual divorce, you can file a one-sided/contested divorce petition before the District Court praying for a decree of divorce and maintenance or alimony for you. Since grounds for one-sided/contested divorce reflect the various challenges and complexities that may arise in the course of divorce proceedings, it is always recommended to consult an expert divorce lawyer to get the right legal advice before filing a contested divorce petition. 3) Apart from this, you can make a complaint online (https://nhrc.nic.in/complaints/complaints/how-to-file-a-complaints) to the Chairperson, the National Human Rights Commission, New Delhi and the State Human Rights Commission along with the Chairperson, National Commission for Women and State Commission for Women who are empowered to investigate complaints related to issues faced by women in distress by sending an email to [email protected] or filing an online complaint. Legal Services Authority seeking free legal services available to women under Sec.12(c) of the Legal Services Authority Act, 1987 to contest the cases in Court for appropriate relief.
