What is the meaning of the below for a court case registered with II ADDL CIVIL JUDGE AND JMFC. Can you help me please.
Filed IA 4 filed U/S 151 of CPC for extension of TI. TI extended till next date of hearing. Advocate filed IA No.5 for extension of time to file WS. Perused. IA 5 is allowed. For WS and objection to IA 2.
When there are 2 FIR on illegal encroachment into my property with DC Office issuing Conversion certificate in 2016 showing road (illegal road 50 feet width over water channel with pipes and no panchayat permission, built 3 months back in February'2019) over the water channel residing within my RTC boundaries and is not government water channel. Why will the court ask for me if I am interested in settlement and injunction suit filed by FIR accused.
What is the best step an advocate is advised to take in the above fraudulently issued Conversion Certificate by DC office for justice?
In civil cases, is it considered a normal practice if defendant never attends court hearing apart from evidence.
Normally without giving an opportunity if Court proceeds to pass ex-parte orders then the other side approach the High Court and again get a direction to Lower Court to receive Written Statement etc. You must see that IAs are disposed on merits and see that you are in better possession to enjoy the property.
