As regards Q.No.1) Is adjournment also chargeable by a lawyer? Ans- Fees are paid to Advocates by clients for appearances before the Court and steps are taken. When an order sheet of the day's proceedings shows No one has appeared on behalf of the petitioner, the Advocate engaged by the Client does not deserve fees for that day. As regards Q.No.2) Is withdrawing the case by way of appearance chargeable by a lawyer? Ans- Withdrawal of a case from the Court requires the active participation/physical appearance of the Advocate for filing a Withdrawal petition and arguing the matter in the course of hearing of the petition before the Court which is chargeable by an Advocate. As regards Q.No.3) Can I withdraw the case myself without going to the lawyer? Ans - Yes, Section 32 of the Advocate's Act 1961 mentions that the court may allow any person to appear before it even if he is not an Advocate. Therefore, one gets the statutory right to defend one's own case on appeal before the Court. In fact, with the leave of the Court, a non-advocate is still permitted to appear even without a local advocate. As regards Q.No.4) Is there any way of knowing whether the lawyer appeared or not on that date? Ans- To verify the appearance of the appointed Advocate, you can apply with the requisite fee for the issue of the certified copy(CC) of the day's proceedings/order sheets of the case to the Registry of the same Court where the case is pending or disposed of.
