Hi, My case about of termination of tenancy of the property, I am a landlord, my father has given it for rent.Original suit was in my favor and preliminary decree made by the court, first appeal was in my favor and final decree made by the civil judge senior division and now applied for execution in the court, And the debtors has filed a second appeal in high court Bangalore which was pending and no stay for any... Now I want to my property for my bonafied use. Pls advise me to proceed further..... Can second appeal stay my execution file? Pls pls advise me

A.Not until they get a stay order on such execution from the higher court of second appeal. Until then you can go ahead with the execution. As soon as they bring such stay. The execution shall cease till the appeal is dismissed.

A.Dear Sir,
In Civil law execution is most important part and mostly second appeal Court may prevent you from executing the decree passed by Lower Court.
