After 2 years of my marriage I have purchased one DDA property on my name with proper registry but original documents of that is with my husband..after filing my dv case he filed property suit on me saying that it was purchased by him on my name.. the payment and dd was made by my account.. I borrowed some money from my parents and relatives to buy this.. Now case is on trial and he moved rule 39 application... My dv case is going on. On cross examination his advocate asked me that your house is on status quo ..i said I am not aware. So my question is I want to get rid of this property case at the earliest
..as my life is stuck like a pendulum.. Want to go for soonest proceedings and my original papers are with my husband.. How can I get that. I have one 5 years daughter ..he wants this house to get the divorce. He is not interested to live with me and my daughter. He lives with his brother and his wife and parents are no more. As my other cases are going on like 498 a, Dv, execution petition for daughter's maintenance.. Can i request the court that he should be restrict to go foriegn...as he works for his US clients and planning to shift there..during proceedings he has been to his same client at USA.
Need your advice

A.File an application in the court requesting the court to not let the husband move away and as such take custody of his passport.

Mr.Mohta, Thanks for your response. Could you please tell where i can move application as three cases are running against him like 498a/DV/Execution case.

He has filed property case against me and my original documents are with him so can i request the court to give the original documents to me. As it is on status quo.. can i request the court to remove it and take the proceedings speedy.

You should do this in the court where the property case is filed.

A.Dear Sir,
You may file a application to seize passport of your husband so that he cannot move to USA.

Sir, Thank you for your response. Already DV case (the stage of case is cross examination on me), execution for daughter maintenance (Misc stage) case and 498a/406 (which is on "arguments on charge" stage) are running against him.

So in which case i should move application and do I need to give any solid reason to request to seize passport of my husband..

How can i get my orginal property papers from him? Could you please apprise?
