Dear sir.. I want to get divorce. I want to live with another. What should I do? At the same time I don't want to quarrel with my partner at the time of divorce. Our ideas are different, quarreling with each other every day. So that I don't want to continue. If I get divorce, what about my children ( 5years girl, 4years boy). My new partner has one boy (7years). What about her child. Please tell me.

A.File a mutual divorce if you don't want to quarrel.
As for the child you can file a custody case if you want the child. [if not] then you need to pay maintenance for the child.
As for the wife you can settle the same in the MOU as to the amount of alimony and maintenance amount. Once and for all.

A.Dear Sir,
It is not so easy to get divorce without her consent. If you wish you can have child custody. You have to pay some alimony to get out of marriage bonds.

Sir....She is not ready to give divorce. But quarreling daily. We're living together now but not as husband and wife physically.
1. How much I've to give her as maintenance if I want to live separately.
2. I'm having my own (father's house). Is there any chance to get my house In future if she occupy when I live for rent in another city.
3. How much portion of asset will I get, have to pay as maintenance to her. I'm earning 10000 per month.
If I live separately without divorce what will happen. Please give examples.
I want to know all details before going.

A.Dear Client,
You can ask your partner to go for a mutual divorce. It takes at max 18 months to get a divorce on mutual consent.

A.if you want to terminate the matrimonial knot, then,
try to settle the matter amicably with your wife involving elders/relatives/friends etc and go for Mutual Consent Divorce which will be decided in 6-18 months, and you both will be free to live life with your wish,

if failed, you can file contested divorce on the grounds of mental cruelty, but it will take around 4-6 years, and once you file divorce case, she will surely go for filling 498a complaint, domestic Violence case, maintenance,
Consult with a legal expert for a prompt solution, and if possible, with your present wife.

A.If Ur wife are ready to divorce then file divorce by mutual consent u will get divorce in just six months.

It will be dependent upon both of you. Any one can take care or both can take care of children
