Two-wheeler Vs Two-wheeler accident on the road - Who is at fault
A month ago, I met with an accident on the road with another two-wheeler when the other party was trying to make a U-turn from my right to left. Both parties left the spot with injuries. The other party was a 72-years-old differently abled old man who did not have a licence to ride the two-wheeler; nor did his vehicle have a valid vehicle insurance. The hospital where the other party was admitted informed the police. Police registered an FIR against me as if I hit the other two-wheeler and because of this injured the other party. I have a valid licence, RC, and vehicle insurance too. Who is at fault or whose argument will be valid in the eyes of law? Can the other party claim hospital expenses using my vehicle insurance? Can I now contact the other party to compromise before the case is decided in the court? If so, should I still legally pay compensation, if they accept my request to close the case?
