Obstruction of Construction Despite SDM Order

Situation: I own 5 decimals of land within a 40-decimal plot. My ownership is supported by a clear title, sale deed, chain deed, RS copy, and a land map, all of which confirm my rightful ownership and possession. Before my purchase, this land was in the possession of Latifur Rahaman for 28 years, and I have been in possession of the land for the past 2 years since the purchase. Despite this clear history of possession and ownership, an individual has surfaced, claiming that this land belongs to him and falsely alleging that I forcibly took possession of his land. The individual initially filed a false case in the SDM court, accusing me of illegally occupying the land. After reviewing the evidence, the SDM court ruled in my favor, confirming my possession and restraining the individual from interfering with my property. Furthermore, a revenue inspector verified my possession. Current Problem: After losing the case in the SDM court, the individual has filed a partition suit in civil court, once again claiming that I forcibly captured his land. While the partition suit is still pending, he is using this as an excuse to obstruct the construction work on my land. His argument is that because he has filed a case in the civil court, he has the right to stop my construction activities. Despite his claims, there is no stay order from the civil court, nor does the pending suit provide him with any legal right to interfere with my possession or construction. However, his continuous obstruction is causing significant delays and financial losses. Questions: Obstruction During a Pending Civil Case: Does the filing of a partition suit give him the legal right to obstruct my construction? Enforcement of the SDM Court Order: How can I enforce the SDM court’s restraining order and ensure that he does not interfere with my land? Contempt of Court: Can his actions be considered a violation of the SDM court order, and can I file a contempt case against him? Police Inaction: Despite the SDM order, local police are not taking any action to prevent him from obstructing the construction. What legal remedies are available to address this inaction? Partition Suit Defense: What steps can I take to defend my ownership in the civil court and ensure that my land is excluded from the partition suit? I have made repeated complaints to the police and other authorities, but no effective action has been taken so far. I am worried that the delay caused by his obstruction and the pending civil case may create further complications.
