Land fraud

I was purchasing a land of 1000 sq yard for Rs 4.4 cr and have paid cheque for 50l out of which 40l was debited from my account along with 4 other partners who were also buying the same land 1000 sq yard but after 2-3 months we were removed and our land was sold to some other person at higher rate or so. Can we file a case against it

Dear Client,
Your query suffers from a lack of information to address it suitably. In a real estate transaction, advance or earnest money is being paid on execution and registration of an Agreement to Sale(ATS) between the parties. But your query apart from the payment of advance through cheque does not reveal any information about the execution of ATS between the parties. In the absence of any ATS, your standalone payment of a meager amount of advance against the purchase of the plot shall not substantiate your claim even if the matter is litigated before the Court. However, you can serve a legal notice to the person concerned for breach of contract which may work or may not work.
