I am working with a private school reputed one in Dwarka for last nine years. Drawing good salary in salary accounts and form 16 also but not salary slip and appointment letter . Last year I had availed maternity leave for my second child but because of family pressure if I plan for my third child then can my school has legal rights to dismiss my service or not. Basically I want to know that if they do so whether I m legally approach to court or not.

A.The school shall not dismiss your service.
Also there is no specific direction for maternity leave for 3rd child however, you can take leave without payment.
In case you want to take maternity leave you can approach the HC or the service tribunals and get a specific order.
However, you should talk to your parents and re think about the idea of a third kid.

A.Dear Madam,
You are ;not entitled for maternity leave but you can take leave without salary etc. They cannot dismiss you. If you wish to have third child then go to Service Tribunal or High Court and get a specific direction to the management. But if you make such issues then your service will be under danger. Try to convince your family members and drop the idea.

If I take 1.5 months leave with out pay then I don't think there will be any issues then.
