Underage driving, triple riding, Bike vs bike accident
Three 17 year old boys were riding triples in a bike at an approximate speed of around 30kmph, while a man in front riding his scooter without helmet steered left then right immediately without indicator. They clashed and both parties fell. The man has suffered a scalp injury requiring 4 stitches, and allegedly has 6 rib fractures. He is admitted in a private tertiary care hospital and they say he is in icu. All these medical information is given by a third party arranging the settlement between the two parties. Both the parties involved in the accident hasn't talked to each other alone. This third party has asked for 3 lakhs for settlement of the case, or else they say they are planning forward with legal action. All 3 boys are of poor household and cannot afford that amount of money. What should be done? The auto rickshaw drivers and other witnesses at the accident scene has vouched that the boys were not the cause of the accident but the man's sudden turning without any indication. The bike the boys rode has insurance. What will be the charges they might be facing if they are going legal? Or is it better to always settle without going legal? If so what if they cant afford such a huge sum like 3 lakhs? Approximate hospital bill, they are saying its rs48,000/- for one day. Is it legally correct for them to demand such a high compensation in this case? Asking one of the staff at the hospital, the boys came to know that the man is stable and only in icu for observation. And also the boy driving the bike is the friend of the bike owner's son, who was the third passenger on the bike. So will the legal action be only against the owner of the bike and son or the friend who was driving is also legally responsible for the incident?
