Credit Card Fraud Case
In Dec'23 on a Sunday evening, somebody fraudulently used my ICICI Bank Credit Card and did 2 transactions totalling Rs 1,35,000. The details seems to show of some PAYTM transaction and I got to know when OTP message was received. As soon as OTP was received, I knew its fraud and I immediately called ICICI Customer Care and blocked the credit card. Next day I reported the issue in ICICI Bank branch also as updated by Customer Care. I followed it up for 1.5 months and finally they reverted saying since OTP got generated, ICICI bank does not have any interference and its some 2nd Level Authorization from which the transactions were processed so bank does not have control over it. I kept sending mail and explanation that I never shared the OTP . However, they didnt agree and kept sending same extract of RBI guidelines that if its due to customer negligence, bank is not responsible - though I maintained that I never shared any details. I thought, since I never shared any details I should not be held responsible for the dues. It should be bank's responsibility to trace out the fraudsters and collect money from them. So I am confused, what is the way out and what is legal point in my favor if they file a case against me for non-payment. I did file Cyber Crime report but no major updates while the the Complaint with RBI Ombudsman seems to be favoring the ICICI Bank as they are focussing only on OTP generation so guessing it might have been shared through some means and that is responsiblity of the customer (may be accessing some weblink or SIM cloning etc) Now the outstanding has been kept increasing with Late Payment Fee etc. Kindly advise, how should I proceed - do I have a chance to fight it out in court if ICICI files case against me for non-payment of dues which has now at Rs 1,55,000? I
