Section 5 of the Right to Education Act, 2009 deals with the student's right to transfer to other schools. As per Section 5(3) of the Act, for seeking admission in such another school, the Head-teacher or in charge of the school where such child was last admitted, shall immediately issue the transfer certificate: provided that delay in producing the transfer certificate shall not be a ground for either delaying or denying admission in such other school and provided further that the Head-teacher or in-charge of the school delaying issuance of transfer certificate shall be liable for disciplinary action under the service rules applicable to him or her. There is no provision for the issue and generation of digital school leaving or transfer certificates. In 2015, the Education Deptt of Govt. of Maharashtra proposed for digitization of transfer certificates, but was not implemented considering its negative impact and mass protest from all stakeholders. you can escalate your grievance before the Dist. Inspector of Schools and the State Education Deptt. for a resolution in the matter.
