Q. Child kidnapping

Is it crime that a father can kidnap his 3 year old child from mother after they are separated but not divorced ...is it legal that father comes to the wife's parental house and kidnap the child due to the custody reasons

It all depends upon the intention of the kidnapper whether he is father or stranger.
