Muslims are governed in their personal matters, including property rights, under the Muslim Personal Law (Shariat) Application Act, 1937, which was introduced to replace customary law. The question of inheritance of property in Muslim law comes only after the death of a person. A wife is entitled to a 1/4th share in the property of the husband if they are childless. After the death of an unmarried Muslim, his/her properties do not devolve under the Muslim law of inheritance. The inheritance of the properties of such Muslims is governed by the provisions of the Indian Succession Act, 1925. According to Section 34 of the Indian Succession Act, where the intestate has left no widow/widower, and where he/she has left no kindred, his property shall go to his lineal descendants or to those who are of kindred to him/her, not being lineal descendants, and, if he/she has left none who are of kindred to him, it shall go to the Government following the doctrine of escheat.
