we want to ask a question on the Mental Health Act.
we want to find sections of law and Judgements which concern the locus-standi for person questioning the mental ability of another individual and motive for such allegation is relevant and necessary to consider the application itself?

In testamentary proceedings, Judge of the trial court allowed one party to cross-examine the other on the mental illness. All the questions were scandalous, irrelevant and without justification. We have filed criminal a complaint as well as a civil suit against the party for defamation.

The judge, while allowing such brutal cross- examination violated various sections of Indian Evidence Act, The Constitution, IPC, etc. for which we had approached the High Court but unfortunately, the complaint is pending with them for more than a year.

We want to approach the lower court to reprimand the judge.
What we think is that when Money and power are involved in the matter, the party alleging defamatory statements should have been directed by the Judge to establish the prima facie case and his bonafide in the matter and not his greed for personal gain and power.
