Landlord and Tenant

Flat Tenant

Hi, I have been residing as a Tenant in Skyview Society, Nehru Nagar, Kurla East. I had informed my Landlord few months back that i would be taking a car hence i would need the parking space allocated for the flat which i am staying in. Now once i have taken the car, my landlord tells me that he has rented out his parking to someone else and is not ready to vacate because thats their permanent source of earning. Having said that my landlord has showed rampant lack of co-operation here. Please advise what should be my course of action.

Dear Sir,
If it is not mentioned clearly in your rent agreement then you cannot insist for it. Just convey him that you are going to vacate the house if he fails to provide you parking place because without parking place you cannot park your new car.

Dear Client,

Tenants have certain rights under the Rent Control Act. If the parking space is included in your agreement or is implied as part of the accommodation, you may have legal grounds to demand access to it.
Check with Local Authorities or Society Rules: In some societies, parking space is allocated as part of the society’s rules, so you could check if the society management has any rules regarding parking space allocation and tenant rights.
If the situation still doesn't resolve, you may want to send a legal notice through a lawyer asking for the parking space as per your agreement.
