Farm land - False Commitment and Mental stress
Sir, I am writing in regard to a farmland purchase in Tamil Nadu. Recently, I finalized a deal for a 10,000 Sqft piece of farmland and paid a token advance of Rs. 40,000. The sellers provided all the necessary documents related to the land, and after sending them for legal verification, I was informed that everything appeared to be in order. However, there was one issue regarding road access from the state highway to the land. The entire property is situated approximately 800 meters from the state highway, with only one 33-foot road leading to it. This 800-meter stretch of road is unapproved, and the sellers failed to provide any documentation regarding it. When I inquired about the lack of approval for the road and requested the relevant documents to verify ownership and access, they assured me they would provide them. Despite my repeated follow-ups over a month, I never received the necessary documents. As a result, I decided not to proceed with the purchase. After persistent efforts, I finally received my Rs. 40,000 refund. However, during this process, I incurred mental stress and legal verification costs amounting to approximately Rs. 50,000, which I spent in good faith while attempting to proceed with the purchase. At the time of making the advance payment, I was assured that there were no legal issues with the property. Based on this assurance, I proceeded with the payment. Since the sellers did not honor their commitment to provide complete documentation, I would like to know if I am eligible to claim the Rs. 50,000 spent on legal verification from them
