Article 371-J of the Constitution of India after its amendment in 2012, empowers the Karnataka government to provide special reservations in public employment and education, including an 8% reservation in educational institutions and government jobs across the state. Promotion rules in Indian Public Sector Undertakings (PSUs) are generally based on a combination of seniority, performance evaluation, and merit, with specific criteria and processes varying by PSU and grade level but generally following guidelines from the Department of Public Enterprises. Promotions typically consider both seniority (length of service) and merit. There are minimum qualifying service requirements for promotion to different grades, which can vary between PSUs and also based on the grade level. Departmental Promotion Committees consisting of senior management level assess the suitability of employees for promotion and make recommendations. Be informed that recruitment, promotion, degradation, etc. are the prerogatives of the management/establishment, strictly followed on the basis of an established recruitment and promotion policy. Only in case of deviation/discrimination/mala fide in the HR policy or rules, if appears on the face of the record, the Central Administrative Tribunal(CAT)/State Administrative Tribunal (SAT) or High Court may entertain an appeal/petition challenging the recruitment/promotion policy/rules violating the well-established HR policy of the organization. Otherwise, a petition may be rejected at the stage of admission. So, try to get the matter reviewed once by an expert professional practicing CAT/SAT matters before challenging the establishment's action before approaching the CAT/SAT or High Court.
