Builder is not returning money on cancellation of flat i booked

The delay in refund of earnest or booking money post cancellation of booking is considered a deficiency in service on the part of the Builder and accordingly, when the housing project is registered under RERA, then an aggrieved flat owner, serving a legal notice to the Builder, can file a complaint against him under Sec.31 of the Real Estate (Regulation and Development) Act, 2016 before the Adjudicating Officer claiming a refund of earnest money with interest and compensation for the delay. The complaint may also be filed against the Builder post-service of a legal notice before the Consumer Court over alleged deficiency in service and unfair trade practice claiming a refund of the earnest money with interest and compensation for delay and harassment within two years from the date of the cause of action, It may be noted that you cannot raise your complaint/claim simultaneously before the Consumer Forum and RERA for the same cause of action at a time. Since the project is RERA-approved and the builder has failed to refund your amount within the committed timeline despite multiple follow-ups. Then you can take the following legal steps for you grievance:
1. You can file a complainant before the RERA tribunal on the ground that their is delay in refund despite cancellation and confirmation by the builder and financial distress due to ongoing EMI payments without possession of the flat.
2. You can send a legal notice to the builder demanding an immediate refund of the money along with interest.
3. If the builder still does not comply after the legal notice you can file a complaint before the District Consumer Disputes Redressal Commission at your district. For deficiency of service and unfair trade practice due to delay in refund.
