If the Magistrate finds sufficient grounds for proceeding with the complaint, he may issue a summons or warrant to the accused under Section 227 of the Bharatiya Nagarik Suraksha Sanhita (BNSS) 2023. You may just get issue a legal notice then if he didn't return the vehicle while complaint with Police and RTO. He may agree to return your vehicle on seeing the contents of your legal notice and accordingly the dispute may be resolved.

Since you signed the TT (Transfer of Title) form while handing over your two-wheeler, the other party may claim ownership. However, if the bike was given only as security for repayment and not as an outright sale, you have legal options to recover it. Since you have already repaid the amount, but the person is refusing to return the bike, this falls under Criminal Breach of Trust (BNSS Section 316) and Cheating (BNSS Section 317) under the new Bharatiya Nyaya Sanhita (BNSS), 2023. You can first file a police complaint at your local station, stating that you repaid the loan, but the person is wrongfully keeping your bike. If the police do not take action, you can escalate the matter by writing to the Superintendent of Police (SP) or filing an RTI inquiry. Along with the criminal complaint, you can also send a legal notice demanding the return of the vehicle, warning of legal consequences if not complied with. If the issue persists, you may file a civil suit for possession/recovery of the vehicle, proving that the money was repaid and that the TT form was not intended as an actual sale.
