Dear client,
Since the electricity department claims the wire is passing through a public road, you need to prove that it crosses your private property.
If the wire is rightfully passing through the road in that case you have to accept such arrangements.
If the wire passes through your property, send a legal notice to the electricity board demanding removal within a specific time.
But before that you need to take the following steps _
Get a certified land survey done by a government surveyor to establish the boundary of your properties and the road.
Obtain land records (Khasra, Khatian, mutation documents) proving ownership of both plots.
Submit a Right to Information (RTI) request to the electricity department asking for:
The original map/plan showing the wire's intended route.
The permission letter and approvals for placing the wire.
The authority responsible for its placement.
If they ignore your request, file a complaint with the Electricity Ombudsman in your state.
If all else fails, file a civil suit for trespass and unauthorized encroachment under property laws. The court may order the removal of the wire if it is illegally placed.
