Regarding defective air conditioner

I have purchased second hand air conditioner 2 months prior and it only worked for 4 days now owner of shop avoiding phone call and not replying to my messages also his shop address is changed so that i can not meet that person

Dear Client,

Even for second-hand items, sellers are responsible if they misrepresented the condition or sold you a non-functional item without disclosing it. You can do this through a lawyer. Send it to the seller’s last known address and through WhatsApp/email if available.

Moreover, if the seller was a business (not just an individual), you can file a complaint at the Consumer Forum.
If the seller intentionally deceived you, it may qualify as cheating or fraud under penal laws of the country. Visit your local police station and file a complaint.

You can seek help of an Advocate for proper legal steps.

Dear Sir,
You may get issue a legal notice saying that the issue will be treated as serious and make viral on internet. Also send the copy of such legal notice to all its regional offices and head office. Thus, you may get positive reply otherwise approach Consumer Court.

Dear Client,
A second-hand AC having no warranty or guarantee of the product may not be considered as a consumer dispute under the Consumer Protection Act, 2019, in the absence of any contract or agreement to repair or compensate a defective product post-sale. However, serving a legal notice to the seller of the second-hand AC, you can file a complaint before the District Consumer Commission seeking appropriate relief and compensation for harassment. The complaint should be filed within two years from the date of the cause of action, i.e, defect noticed in the product post-sale.
