Bank account blocked - frozen

Dear Client, Once a cybercrime scam involving suspicious or fraudulent transactions is reported online to the National Cyber Crime Reporting Portal(NCCRP), on the instruction of the Cyber Crime Cell, the investigating team starts the routine process of investigation immediately freezing the suspected accounts of fraudsters and the victim's Bank account obtaining an order from the court of Magistrate under Sec.102 Cr.PC to that effect and the accounts remain inoperative till the completion of the investigation. The length of time it takes to investigate a cybercrime can vary greatly depending on the complexity of the case, the resources available to the investigators, and the cooperation of the victim. Therefore, to unfreeze the debit freeze account, you have to obtain an NOC from the Cyber Cell. You may contact the District Cyber Crime Cell to get the matter resolved as per their direction/advice and contact your Bank accordingly. You may consult with a cybercrime expert to navigate the issue in the right way.

Given your situation, where your Bank account was blocked by the Cyber Crime unit in Ahmedabad—a place you've never been to—and considering your financial status and the misuse of your account, you are legally entitled to challenge the freeze and seek restoration of access to your account.

You should first prepare a detailed representation addressed to the Cyber Crime Office, Ahmedabad, explaining your background, that you are from Manipur, living in Churachandpur district, and that you were unaware your account was being misused. Include facts such as: you were given ₹10,000 by a person who said she would use your account in Delhi; she took your ATM card and passbook; and you later discovered your government benefit funds (like PMAY, PM Kisan, and job card wages) were credited into the same account, which you never intended to be misused. Also explain that once you realized the misuse, you asked for the return of your documents, but she refused and misled you. Attach a copy of the letter you received from the Cyber Crime unit, along with your Aadhaar, bank passbook copy, job card, and any benefit scheme documents showing your status as a government beneficiary. You can submit this representation physically or by Speed Post with tracking, and also email it to the Cyber Cell (if they have an official email) asking for a No Objection Certificate (NOC) to release your account.

If there is no response or delay, you can file a written complaint to the State or National Cyber Crime Portal explaining your situation. If still unresolved, you have the legal right to approach the High Court under Article 226 of the Constitution through a writ petition seeking the unblocking of your account, since it affects your right to livelihood under Article 21. The petition can also include a prayer for directions to the Cyber Crime Office to issue a release order for your bank account, as you are an innocent victim of someone else’s fraud. You may also consider lodging an FIR against the person who misused your account, especially if you know her name or location, as this can help establish that you were defrauded.
