The Rights of Persons with Disabilities (RPwD) Act was enacted in the year 2016 and came into force on 19th April 2017. The RPwD Act makes it unlawful to discriminate against someone based on their disability, unless such discrimination is a proportionate means of achieving a legitimate aim. The RPwD Act provides protection for persons with disabilities from all forms of abuse, violence, and exploitation. Article 21 of the Indian Constitution guarantees the right to life and personal liberty, including the right to live with dignity, which is also protected for persons with disabilities. So, in the given scenario, you can make a complaint online (https://nhrc.nic.in/complaints/complaints/how-to-file-a-complaints) to the Chairperson, the National Human Rights Commission, New Delhi and the State Human Rights Commission who are empowered to investigate complaints related to discrimination based on disability and infringement of the constitutional rights of any citizen. If you are a minor, then be informed that under Section 4 of the Juvenile Justice (Care and Protection of Children) Act, 2015, the State Government has to constitute for every district, one or more Juvenile Justice Boards consisting of a Metropolitan Magistrate or a Judicial Magistrate of First Class not being Chief Metropolitan Magistrate or Chief Judicial Magistrate for exercising the powers conferred by the Code of Criminal Procedure, 1973 and discharging its functions relating to children in conflict with law under this Act. In the given scenario, you may approach the Juvenile Justice Board of the concerned district, explaining the ordeal and threat/apprehension you are facing from your step-parents, seeking appropriate relief in the matter. You can also seek the help of a social service organization or NGO like the Bachpan Bachao Andolan by contacting their Complaint Cell(24 X 7) helpline, Child Helpline No, 1800 102 7222, GOVT. HELPLINE NUMBER 1098, and writing to the Chairperson, BBA through email to: complaints@bba.org.in to resolve the issues.
