POSSESSION CERTIFCATE

This is bring to kind notice that Our land is Great Grand mother Name in the document Registered in 1943 But Great Grand mother died Great grand father died and Grand father Grand mother died but land is 1 acre 0.50 registerd 0.50 acre not regsiterd but land is adganl report 0.38 cents shown in ap meebhoomi site that be not shown in My Great Grand mother name How can i solve the problem REGSISTARTION PURPOSE POSSESSION CETIFCATE IS VALID OR NOT VALID PLEASE SUGEST THEM.

Dear Client,
An individual gets the right to ancestral property by birth. Typically, ancestral property refers to property that has been inherited for four or more generations and has not been divided or sold off. Until and unless an undivided ancestral property is partitioned through a decree of partition passed by a Civil Court, a coparcener or legal heir cannot get his/her share in the said property and cannot dispose of their individual share in the property to others. Once the ancestral property is partitioned, it ceases to have the character of 'ancestral property'. It becomes 'self-acquired property' in the hands of the family members who have received it, giving them an unfettered right to deal with and/or dispose of their share in such property. Being a coparcener and legal heir of the said undivided ancestral property, you can file a civil suit seeking an order of partition before the competent civil court to obtain your share in the said property and based on the decree of the partition suit, you can register your share in your name under the Registration Act, paying the requisite stamp duty. A standalone possession certificate shall not serve the purpose of registration unless that possession qualifies ownership of the property, applying the doctrine of adverse possession as laid down under Article 65 of the Limitation Act, 1963.
