13. Delayed registration of births and deaths (1) Any birth or death of which information is given to the Registrar after the expiry of the period specified there for, but within thirty days of its occurrence, shall be registered on payment of such late fee as may be prescribed. (2) Any birth or death of which delayed information is given to the Registrar after thirty days but within one year of its occurrence shall be registered only with the written permission of the prescribed authority and on payment of the prescribed fee and the production of an affidavit made before a notary public or any other officer authorised in this behalf by the State Government. (3) Any birth or death which has not been registered within one year of its occurrence, shall be registered only on an order made by a Magistrate of the first class or a Presidency Magistrate after verifying the correctness of the birth or death and on payment of the prescribed fee. (4) The provisions of this section shall be without prejudice to any action that may be taken against a person for failure on his part to register any birth or death within the time specified therefor and any such birth or death may be registered during the pendency of any such action.

Section 13 of the Birth and Death Registration Act, 1969 deals with the delayed registration of birth and death of any citizen. As per Sub-Section 3 of Section 13 of the said Act, any birth or death which has not been registered within one year of its occurrence, shall be registered only on an order made by a magistrate of the first class or a Presidency Magistrate after verifying the correctness of the birth or death and on payment of the prescribed fee. As per Sub-Section 4 of Section 13 of the said Act, the provisions of this section shall be without prejudice to any action that may be taken against a person for failure on his part to register any birth or death within the time specified therefor and any such birth or death may be registered during the pendency of any such action. Being the above proposition of governing law, you have to apply to the First Class Magistrate concerned along with the prescribed documents explaining the reason behind the delay in the application and praying for an order for the issue of a death certificate in respect of great-grandfather and great-grandmother. The death certificate, to be issued in compliance with the Court's order, includes both the Date of death and the Date of Registration, and is considered the Late Entry Death Certificate. Until and unless an undivided ancestral property is partitioned through a decree of partition passed by a Civil Court, a coparcener or legal heir cannot get his/her share in the said property and cannot dispose of their individual share in the property to others. Once the ancestral property is partitioned, it ceases to have the character of 'ancestral property'. It becomes 'self-acquired property' in the hands of the family members who have received it, giving them an unfettered right to deal with and/or dispose of their share in such property. Being a coparcener and legal heir of the said undivided ancestral property, you can file a civil suit seeking an order of partition before the competent civil court to obtain your share in the said property and based on the decree of the partition suit, you can register your share in your name under the Registration Act, paying the requisite stamp duty.
