Fraud and Absconding tenant

After signing a rental agreement with a person named Dipak, his boss who was only a witness illegally began residing in your flat. Upon discovering that he is involved in land scams and has a pending case in Pune, you asked him to vacate. Despite giving him notice through email as per the agreement, he has failed to leave even after the 30-day period. Your Attempts to contact either party have failed, and further scrutiny revealed that the Aadhaar addresses they provided are false. Neither the police nor the housing society is taking action, possibly out of fear of legal repercussions.

In such a case, you should immediately send a formal legal notice through a lawyer and file an eviction suit in the Small Causes Court under the Maharashtra Rent Control Act. Simultaneously, file a written complaint with the police under IPC sections related to cheating, criminal trespass, and forgery. If the police do not act, escalate the matter by filing a private complaint before a Judicial Magistrate under Section 200 of CrPC. Also, consider filing an RTI to pressure the police and put the society on notice through a written complaint.

If you go to Civil Court by filing eviction suit it may take few years to get vacated premises. Better approach Higher Police Officers or wait till your tenant voluntarily hand over vacant possession of your residential house.
