Dear Client,
You may be able to take legal action against the seller only if you can prove that a suicide did occur in the flat, the seller knew about it, and intentionally concealed this fact from you.
There is no legal obligation for sellers to disclose past deaths unless specifically asked, and courts rarely cancel sales based on "stigmatized" properties unless there's clear fraud or misrepresentation. Since the title and documents are clear and there is no pending legal case, your legal options are limited unless you find official proof of the incident.
To verify if a suicide occurred, you can file an RTI with the local police station asking if any FIR, unnatural death, or suicide was registered at that address, or try checking news archives or asking the society office or security staff. If evidence confirms the suicide and the seller’s knowledge of it, you may consider filing a civil suit for misrepresentation or a complaint with the consumer forum for mental distress.
However, unless the seller voluntarily agrees to take the flat back and refund your money, there is no legal requirement for them to do so.
Consult an advocate for any legal steps.
