Complaint about black money and tax evasion

Be aware that the Income Tax Department has to investigate some many complaints lodged by so many whistle blowers. Unless you submit such complaint with supporting documents then it may be materalised. Better collect the evidence and lodge complaint by disclosing your name and address because the IT Department never disclose your identity and if your complaint materialised then you are also entitled for 20% price amount.

CBDT launches e-portal for filing complaints regarding tax evasion/Benami Properties/Foreign Undisclosed Assets. The public can now file a Tax Evasion Petition through a link on the e-filing website of the Department https://www.incometaxindiaefiling.gov.in/ under the head “File complaint of tax evasion/undisclosed foreign asset/ benami property”. The facility allows for the filing of complaints by persons who are existing PAN/Aadhaar holders as well as for persons having no PAN /Aadhaar. After an OTP based validation process (mobile and/or email), the complainant can file complaints in respect of violations of the Income- tax Act, 1961, Black Money (Undisclosed Foreign Assets and Income) Imposition of Tax Act, 1961 and Prevention of Benami Transactions Act (as amended) in three separate forms designed for the purpose. Whistle Blowers Protection Act, 2015 is an Act of the Parliament of India that provides a mechanism to investigate alleged corruption and misuse of power by public servants and also protects anyone who exposes alleged wrongdoing in government bodies, projects, and offices. The wrongdoing might take the form of fraud, corruption, or mismanagement. Every complaint has to include the identity of the complainant. The Act prescribes penalties for knowingly making false complaints. An anonymous complaint is neither permissible nor acceptable even in a Court of law. A complainant has to prove their complaint against the O P/accused before the Court. Further, Project VIGEYE (Vigilance Eye) is a citizen-centric initiative, wherein citizens join hands with the Central Vigilance Commission in fighting corruption. Users can lodge their grievances and complaints online, which also requires the personal details of the complainant for registration and login to the portal.

The Income Tax Department does accept information about tax evasion, including anonymous complaints. They have a mechanism for this under Income Tax Informants Reward Scheme, 2018, Benami Transactions Informants Reward Scheme, 2018

However, to be eligible for any reward, the complainant must identify themselves and follow the prescribed procedure. Anonymous complaints generally do not qualify for rewards but may still be acted upon if found credible.

There are usually no legal consequences. The department may ignore the complaint if it's not supported by some form of basic facts or clues. However, false or malicious complaints (even anonymous ones) that are later proven to be intentionally misleading could lead to legal consequences if your identity is uncovered and it is shown that you acted with malice.

But in general, if you genuinely suspect wrongdoing and simply provide that information anonymously, you are unlikely to face legal trouble.
