Responsibilty of flat owner Responsibilty of flat owner

Good evening, I am residing at Mumbai but my second home is at Talegaon Dabhade in Pune .
Due to paucity of time I am unable to visit the flat which is not rented out. On my visit to the flat after two years .I observed that due to leakage from the bathroom of flat above my flat .
The flat from which there is a leakage is rented . I told the tenant about leakage and also asked him to provide contact number of flat owner . However that flat owner is not picking up phone.
I desire to get it repaired soon.
My question is - whether there is a mishap to the construction due to this leakage, Please let me know who would remain responsible for this. Me or the flat owner on the top floor
Thank you for your attention.
Regards

A.Dear client , first you need to point out the said leakage problem to your society chairman. If they dials to take cognizance of the same , then you need to send legal notice to that flat owner and society demanding the necessary repairs to save the building.
