You are entitled to immediate protection under the Domestic Violence Act, which covers not just physical violence, but also:
Verbal and emotional abuse,
Economic abuse, and
Mental harassment.
As per Section 3 of the Act, the conduct described by you clearly falls within the definition of domestic violence.
You may approach the Metropolitan Magistrate Court or the Protection Officer in your area and seek the following reliefs:
Protection Order under Section 18 – to restrain them from committing any further acts of abuse or harassment.
Residence Order under Section 19 – to ensure your right to reside peacefully in the shared household.
Monetary Relief under Section 20 – to claim compensation for emotional and physical harm.
You also have the option to lodge a criminal complaint under the Bharatiya Nyaya Sanhita, 2023, for the following offences:
Section 112 BNS – for voluntarily causing hurt, which covers any act of physical assault or injury inflicted by your father or brother.
Section 131 BNS – for intentional insult with intent to provoke breach of peace, applicable in case of verbal abuse meant to incite you or cause mental distress.
Section 137 BNS – for criminal intimidation, applicable if they are threatening you with harm, coercion, or emotional blackmail.
Section 79 BNS – for uttering any word or making any gesture intended to insult the modesty of a woman, which covers acts of indecent speech or gestures by male family members.
Compensation Order under Section 22 – for the mental agony, trauma, and violation of your rights.
Article 21 of the Constitution of India guarantees you the Right to Life with Dignity. No one – including your father or brother – has the legal right to deny your autonomy, your freedom of choice regarding marriage, or subject you to emotional control or threats.
Given that your mental health is being severely affected and you have expressed suicidal thoughts, I strongly recommend that you:
