Hi All,

I booked a under construction flat in gaziabad in 2014. My payment term was construction linked.
In the month of Nov-18 builder sent me a letter mentioning offer of possession and mentioned to submit stamp paper charges but he did not send me any demand letter for pending 5% demand. I followed him over emails but he not responded till now.

Later now in May-19 he sent me final demand letter also mentioned stamp duty charges pending from nov-18 .

I have paid my dues to builder except stamp duty charges.


Now I have below mentioned queries
1 Is there any penalties I will be liable to pay , if I hold my stamp duty or registry till my issue solved with builder ?
If yes than what is penalty rate by GDA.

2 Builder is not responding over emails and not providing details .
Example in my agreement EDC and IDC charges mentioned but in final demand letter he not mentioned any EDC IDC charges nor in payment receipt . and when I sending emails no revert but when visited their office for details than they increase my GST rate to 12% and told me they mistakenly charged 1% previously.

3 if builder charging gst rate is 12% than will I am able to receive any rebate as somebody told me 50% rebate will builder provide as rebate.

First get issue a legal notice and make your stand clear and then proceed.

A.U will need to file complaint against the builder to the rera immediately because GST applicable only 8% but he was charged 12% or not providing original receipt to you
