Hi sir/madam I'm from Bangalore I file a case against father in law and my husband as domestic violence both parties compromise with me and made me to close that case as they are taking care about me and son,but after few few weeks my husband send divorce notice to me and after one year he closed the divorce notice now again he reopened the same divorce notice my question is can I file maintenance case in that divorce case and what are the benefits can I claim for me and my son in that divorce case, my humble request plz give information ...based on this...

A.Yes, you can file a case for claiming maintenance under sec125 CRPC

A.Yes, you can claim maintenance by filing an application under section 24 in the divorce case,
you can also restore your previous case withdrawn by you or can file a fresh case also under section 125 CrPC

A.Hello Madam
You can claim maintenance case as per the rules sec 125 Code of Criminal Procedure it states a wife who is unable to maintain herself or her minor child then she is entitled for maintenance.
It also depends upon the circumstances too.

Hi sir thanks for your information but one small doubt under sec125 code criminal procedure that case can I file in same divorce court itself or it will come different case and different court. Plz reply for this question sir...

Your local divorce lawyer can help you with the filing of your divorce case and maintenance case as per your jurisdiction.
Both are two different cases which are filed separately in the your concerned jurisdiction court.
