Contractual employee Company terminated me

Regardless of the class of employee, either contractual or permanent, any termination from employment requires prior notice from the employer. Even in fixed-term contractual employment, a termination before the expiry of the tenure of the contract requires prior notice showing the ground of termination. The relationship between a contractual employee and the employer is governed by the terms and conditions of the contract, which appear in the offer/appointment letter issued to an employee engaged on contract. The Contract Labor(Regulation and Abolition) Act, 1970, also governs the service conditions of contractor workers and applies to an establishment engaging 20 or more contract workers. So, if you possess any such appointment letter, then go through the said document to assess the breach of contract. If it appears to you that your termination from employment is in breach of the terms of the contract, then serving a legal notice to the Company, you can raise your grievance over the alleged illegal and wrongful termination from the employment on the vague ground of poor performance before the Labour Commissioner or the Chief Inspector, Shops and Establishments to resolve your grievance, failing which you can represent your grievance before the Labour Court seeking appropriate relief in the matter. In the case of Feroz Ahmed Sheikh v. Union Territory of J&K, 2023 SCC OnLine J&K 1095, decided on 16-12-2023, the Hon'ble High Court of J & K, relying on several judgements of the Supreme Court cited in the case, ruled that Contractual Appointment can’t be terminated without affording the opportunity of hearing to the employee. The Court observed that it is settled law that even a contractual appointment cannot be terminated without affording an opportunity of hearing, if founded on allegation and/or misconduct, which casts a stigma on such an employee. Hence, it is recommended to consult with an Advocate experienced in labour laws for tailored advice and steps to resolve the issue in the right way.
