A GPA holder is an agent to the principal, and such an agent is acting on behalf of the principal. A GPA grants the holder the power to act on behalf of the property owner for specific purposes, which can include applying for utilities like electricity. The GPA must be valid and specifically grant the power to apply for and manage electricity connections. In some cases, if the registered GPA is irrevocable then an NOC from Owner is required by the electricity provider. However, sepending on the specific requirements of the electricity provider and the type of property, you might need additional documents like a sale deed, allotment letter, or lease agreement. Some electricity providers might require a No Objection Certificate from the property owner, especially if the GPA is not explicitly mentioned in the title deed. In the given scenario, you have two options to resolve the issue. 1) All the authorized/licensed Electricity Supply Agencies have their customer grievance redressal cell following the provision of sub-section 5 of Section 42 of the Electricity Act, 2003 which is handled by the designated Grievance Redressal Officer(GRO). You can escalate your grievance to the concerned GRO for a resolution to your grievance failing which you can approach the Electricity Ombudsman appointed by the State Electricity Regulatory Commission following the provisions of Sub-Section 6 of Section 42 of the Act who shall settle the grievance of an aggrieved applicant within such time as may be specified by the State Commission. 2) Finally, an aggrieved applicant can file a complaint against the electricity distribution company over deficiency in service before the District Consumer Dispute Redressal Commission seeking appropriate order along with compensation for harassment. The complaint should be filed within two years from the date of the cause of action. If required, seek advice from the legal professional to navigate the issue in the right way.
