Non-payment of maintenance charges by members is considered a dispute concerning the society's financial matters and can be addressed under Section 96 of the Gujarat Co-operative Societies Act, 1961, Specifically, disputes related to the recovery of dues, including maintenance charges, fall under the purview of Section 96 of the Act and can be referred to the Registrar for resolution. The Registrar of the Cooperative Societies, upon being satisfied that a dispute exists, can either decide the matter himself or refer it to a nominee or a board of nominees for resolution. So, whan a dispute over non-payment of maintenance charges is not resolved by committee members, you can approach the Registrar of the Cooperative Societies under Section 96 of the Act for a resolution.
